On May 25, 2018, a new European privacy regulation called The General Data Protection Regulation (GDPR) will come into effect. As a valued customer of Boats Group, it is important that you understand the impact of this new regulation and know what is required of you moving forward.

What is GDPR?

GDPR impacts users located in the EU and EU citizens, regardless of where they are located when they receive communication and/or conduct business with you. It applies to all companies selling to and storing personal information about users in Europe and EU citizens, including companies on other continents. It provides users and citizens of the EU with greater control over their personal data and assurances that their information is being securely protected across Europe.

This new data protection regulation puts the consumer in the driver’s seat, and the task of complying with this regulation falls upon businesses and organizations.

Next Steps

As an active business that utilizes a Boats Group service, we require that all of our customers submit a signed “Data Protection Agreement” before May 25, 2018.

What is GDPR?

It provides users and citizens of the EU with greater control over their personal data and assurances that their information is being securely protected across Europe.

This new data protection regulation puts the consumer in the driver’s seat, and the task of complying with this regulation falls upon businesses and organizations.

What is considered personal data?

According to the GDPR directive, personal data is any information related to a person such as a name, a photo, an email address, bank details, updates on social networking websites, location details, or a computer IP address.

What does GDPR-compliant mean?

Boats Group is working with an external auditor to ensure GDPR compliance. Part of the compliance includes obtaining a signed Data Protection Agreement from every Boats Group customer before May 25, 2018.

The GDPR requires organizations to implement reasonable data protection measures to protect the personal data of consumers and employees against data loss or exposure. To achieve that goal, the law regulates all areas related to data management and processing, from obtaining user consent to setting up company-wide data protection practices and handling data breach incidents.

When does GDPR take effect?

GDPR took effect on 25th of May, 2018.

My business doesn’t sell boats outside of the U.S., so how does this impact me?

The impact of GDPR is far reaching, regardless of whether you are located or do business in the EU or US. It’s important that you educate yourself about GDPR and consult legal counsel if you think it is necessary.

Why do I have to sign this agreement?

GDPR legislation impacts any company storing information, so you have likely received similar communication from other companies (ie., Netflix, Facebook, Twitter, etc.). Because you receive leads from Boats Group, GDPR impacts you. The regulation is being driven by the European Union not Boats Group. However, there are a lot of benefits of GDPR for anyone with a digital footprint. GDPR will allow more control over how personal and sensitive data is used. It will also introduce a more trust-based relationship between businesses and consumers that will provide assurance that each is acting in the other’s best interests.

Does this change mean that I can’t do anything with the leads Boats Group sends to my business?

The core value of Boats Group is to assist our industry partners in selling boats, and this will not change. All businesses are making improvements to protect personal information and we are committed to this, as well. You are still able to use the leads we send you to sell boats; however, it is your responsibility to ensure that you are GDPR-compliant in how you manage that data.

What about the leads that I get from my website?

If you have a Boats Group website, any leads you receive will need to be treated the same as leads provided from our portals.

If your website is managed through a provider other than Boats Group, you should contact them directly to determine what steps need to be taken. All companies are working to gain compliance as this is not optional.

What do I need to do to notify my customers?

Educate yourself about GDPR and consult legal counsel if you think it is necessary.

What happens if my business doesn’t comply with GDPR?

The penalties for not complying include fines of up to 20 Million Euro or 4% of global annual turnover within a given year, whichever is higher. We suggest that you educate yourself about GDPR and consult legal counsel if you think it is necessary.
